Terms of Service

These Terms are the contract between you (“you”, “Member”) and BackPocket, Inc. (“BackPocket”, “we”, “us”). Using any BackPocket product means you agree to this contract.

1. Eligibility & account security

You must be at least 13 (16 in the EU/UK) to use BackPocket. Provide accurate registration information, keep your credentials secret, and notify us immediately if you suspect unauthorized access. You are responsible for any activity under your account.

2. What you can (and can’t) do

  • No illegal, infringing, or abusive content.
  • No reverse engineering, probing for vulnerabilities, or bypassing technical protections.
  • No impersonation, spam, or automated traffic without written approval.
  • No interfering with networks, carriers, or third-party integrations that power the service.

We may suspend or terminate accounts that violate these rules.

3. Messaging consent

When you share your phone number you authorize BackPocket to send SMS/MMS, WhatsApp, and similar messages for authentication, reminders, and product updates. Message frequency varies with usage. We log consent events (timestamp, channel, IP) and honor carrier-compliant keywords automatically.

4. Subscriptions, trials & billing

Paid plans renew automatically until cancelled. We bill in advance for each term and may suspend access if a payment fails. Unless required by law, fees are non‑refundable. Workspace agreements follow the terms of the signed order form. Taxes may apply depending on your billing address.

5. Your content & licenses

You own the notes, media, and data you save. You grant BackPocket a limited, revocable license to host, process, analyze, and display that content solely to provide the service. We do not sell or monetize your content. Aggregated metrics may be used to improve BackPocket provided they cannot identify you.

6. Privacy & security

Our Privacy Policy explains how we collect and protect data. We use encryption in transit and at rest, role based access controls, and continuous monitoring. You agree to notify us promptly of any suspected breach related to your BackPocket account.

7. Service changes

We continuously improve BackPocket and may add or remove features without notice. If we discontinue a material feature of a paid tier we will provide advance notice and options to export or cancel.

8. Feedback & beta features

If you share feedback or ideas, you grant us permission to use them without obligation. Beta or preview features are provided “as is” and may be withdrawn at any time.

9. Disclaimers & limitation of liability

BackPocket is provided “as is”. To the fullest extent permitted by law we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Our total liability arising out of these Terms is limited to the greater of the amount you paid in the 12 months before the claim or $100 USD. Neither party is liable for indirect or consequential damages.

10. Governing law & venue

These Terms are governed by Delaware and U.S. federal law. Disputes will be resolved in the state or federal courts located in San Francisco, California, unless a separate written agreement specifies otherwise.
